Market Education Webinar to discuss the pre-publication draft of the ISDA/FOA Client Clearing Addendum — April 30 and May 2

As the volume of client clearing increases across products and platforms, there was concern that it would not be a scalable solution for either clearing members or their clients to adopt different client clearing models and documentation across multiple Central Counterparties (CCPs). Therefore, the Addendum has been developed by a working group of ISDA and FOA members (including representatives from buy-side and sell-side institutions) in order to deliver a standardised form of client-facing documentation that can apply to cleared transactions at any CCP, whilst ensuring that client protections in relation to portability and margin segregation are preserved regardless of the underlying legal structures used by the CCPs to achieve them. ISDA will be holding two Webinars to further describe the document. The ISDA/FOA Client Cleared OTC Derivatives Addendum — Guidance Note describes the key features of the Addendum.

Webinar: Non Financial Corporates’ requirements under EMIR — February 27

With EMIR Regulatory Technical Standards just weeks from being in force, non-financial companies using derivatives are facing a massive change in the conditions in which they can use derivatives to manage their commercial risks. These changes will range from new requirements to use clearing houses (for the largest non-financial users) to new operational requirements (for example on trade confirmations and portfolio reconcilitation) which will affect all non-financial end users, in some cases in effect from the second half of March 2013.

In light of this, ISDA has organized this webinar to inform non-financial companies of the impact on them. Companies are invited to join to help them understand how these requirements affect them, whatever the nature and scale of their activity in OTC derivatives. We will also look at changes to industry documentation affecting non-financial counterparties and their counterparties.

Dodd-Frank Implementation Webinar: An Overview of ISDA Requests and CFTC Actions — January 25, 2013

Your EMIR Obligations: an ISDA Member Call — January 10, 2013

With Regulatory Technical Standards now being finalised, firms can expect to go live from March 2013 on key requirements under the EU legislation for clearing, trade reporting and the treatment of bilateral transactions (EMIR). In light of this, ISDA organised a web-only event to inform members of the impact of EMIR. SIFMA/ISDA/FIA Member Call: CFTC No-Action Letters, FAQs, and Q&As – October 25 2012

As the compliance date for a number of the CFTC’s Title VII rulemakings approached on October 12, the Commission released a flurry of No-Action Letters, FAQs and Q&As in an effort to provide much needed relief to market participants. These releases covered a number of rulemaking categories, including guidance on issues relating to which swaps to include in swap dealer and MSP de minimis threshold calculations, cross-border scope, securitizations, FX forwards and swaps, and Commodity Pool and ECP concerns. SIFMA, ISDA and FIA held a Joint Member Call to discuss what relief was provided, whether it goes far enough, and what more can be expected. ISDA Member Call: US Municipal CDS Terms – Market Education, March 5, 2012

ISDA published the 2012 ISDA U.S. Municipal Reference Entity Supplement to the 2003 ISDA Credit Derivatives Definitions (the “Supplement”) and the 2012 ISDA U.S. Municipal Reference Entity CDS Protocol (the “Protocol”) on March 5, 2012. The Protocol will be open for adherence from March 5 until April 2, 2012 and the implementation date for the Protocol will be April 3, 2012.

ISDA Member Call: FATCA Market Education, November 21, 2011

The Foreign Account Tax Compliance Act (FATCA) requires foreign financial institutions (FFIs) that opt in to report information to the IRS regarding their US account holders. The act intends to assist the IRS in enforcing US taxpayer compliance and to potentially withhold 30% US tax on payments made to account holders or other FFIs. Any entity which makes a payment of US source income (or items considered US source for FATCA purposes) must consider whether the payment is subject to FATCA withholding. ISDA Member Call: MiFID Review, Wednesday October 26, 2011

The EC published legislative proposals relating to the review of the Markets in Financial Instruments Directive (MiFID) in late October. ISDA held a Members Call on October 26 to provide an initial analysis of the key proposals impacting OTC derivatives markets and to seek feedback from members.
