<p><strong>ISDA submission providing Preliminary Comments on the Indian Ministry of Finance Consultation on the draft Financial Resolution and Deposit Insurance Bill 2016 and the Report of Committee to Draft Code on Resolution of Financial Firms</strong></p> <div style="height:20px;"></div> <p>The Indian Ministry of Finance declined to extend a short submission deadline for comments on the consultation on the draft Financial Resolution and Deposit Insurance Bill 2016, which provides both policy and legislative proposals. The ISDA submission dated October 14, 2016 therefore provides preliminary comments which are supplemented by the further comments provided on November 4, 2016. The preliminary comments focus on the proposals relating to bail-in, temporary stays, cross-border recognition of resolution actions, and safeguards for netting, set-off and collateral arrangements.</p>

The response focusses on the key themes of transparency and certainty, preservation of set-off and netting and ensuring consistency with international standards, with a particular focus on bail-in, temporary stays, cross-border recognition of resolution actions, and safeguards for netting and set-off arrangements. </p>

<p><strong>ISDA response to UK PRA’s consultation on the Contractual Recognition of Bail-In</strong></p> <div style="height:20px;"></div> <p>ISDA has responded to a consultation paper from the UK Prudential Regulation Authority (PRA) which sets out proposals to amend the Contractual Recognition of Bail-In Part of the PRA Rulebook, along with a draft supervisory statement reflecting the PRA’s expectations. The PRA consultation paper outlines a proposal to amend the PRA rules to disapply the contractual recognition requirement for liabilities other than unsecured debt instruments where the inclusion of such language is impracticable. ISDA’s response focuses on the non-exhaustive list of examples of impracticability set out in the PRA’s draft supervisory statement.</p>
